This End User License Agreement (the "Agreement") is between you and Wilburn Pacific Company ("we", "us"), the publisher of SpamBlaster(the "Software"). By installing or using the Software, you agree to these terms. If you do not agree, do not install or use the Software.
1. License grant
SpamBlaster is free for personal, individual use. Subject to this Agreement, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software on computers you own or control for your own individual use.
Commercial and enterprise use requires a Fleet license. Use by or for a business, organization, government body, or other entity, or any use in connection with commercial activity, is not covered by the free individual license.
1.1 Fleet licenses (commercial use)
A Fleet license covers one named individual's commercial use of the Software, on the computers that person owns or controls. Fleet licenses are sold as an annual subscription, per seat.
- A seat is an assigned account. Each seat is held by one SpamBlaster account belonging to one named individual. Seats are not concurrent-user licenses and are not shared, pooled, or rotated among people. Reassigning a seat when a person leaves the organization is permitted and expected; rotating one seat among several active users is not.
- A single Fleet licensecovers the purchaser's own commercial use.
- Two or more Fleet licenses make the purchaser a Fleet Commander. A Commander's own commercial use is covered by their command, and every purchased seat may be assigned to another individual. A Commander may reassign seats at any time.
- Organizations should buy the number of seats equal to the number of individuals who will use the Software for commercial purposes.
1.2 Sponsorship
A Reactor purchase is a voluntary contribution supporting the Software's development. It is not a commercial license, confers no commercial use rights, and is not refundable. Any recognition or early-access material associated with sponsorship is provided as a courtesy and may change or end at any time.
1.3 Service plans
Optional paid services (for example synchronization or cloud processing) may be offered separately. A service plan does not grant commercial use rights: commercial use requires a Fleet license regardless of any service plan held. Service plans, when offered, are governed by the additional terms published for them.
1.4 Term and lapse
Paid licenses run for the period purchased. If a Fleet license lapses, expires, or is cancelled, the commercial-use rights it granted end, and continued use of the Software is governed by the free individual license: that is, personal, individual use only. The Software continues to function; the permission to use it commercially does not continue.
1.5 Verification
The Software may store a license record issued to your account and check it locally on your computer. The Software does not transmit your mail or your rules to us for this or any other purpose.
2. Ownership
The Software is licensed, not sold. Wilburn Pacific Company and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement grants you no rights other than the license expressly stated here.
3. Restrictions
You may not:
- sell, rent, lease, sublicense, or otherwise redistribute the Software beyond the rights granted in this Agreement;
- reverse engineer, decompile, or disassemble the Software, except to the extent that applicable law expressly permits despite this limitation;
- remove or alter any proprietary notices in the Software; or
- use the Software in violation of applicable law.
4. Your data
SpamBlaster is local-first: it filters your mail on your own machine, and your mail content is not sent to us. How the Software and our website handle data is described in our Privacy Policy.
Services are separate. This Agreement covers the Software. Optional services you buy from us have their own terms, because a service does something the Software does not: it holds data on our infrastructure. Vortex, the sync service, is covered by the Vortex Service Agreement. Nothing in that agreement changes what the Software promises here.
5. Disclaimer of warranties
The Software is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be error-free, uninterrupted, or that it will catch or block any particular message. You are responsible for reviewing important mail.
6. Limitation of liability
To the maximum extent permitted by law, Wilburn Pacific Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, mail, profits, or business, arising out of or related to the Software or this Agreement, even if advised of the possibility of such damages. Our total liability for any claim relating to the Software will not exceed the amount you paid for the Software (which, for the free individual license, is zero).
7. Termination
This Agreement applies for as long as you use the Software. It terminates automatically if you breach it. On termination, you must stop using the Software. The sections on ownership, disclaimers, limitation of liability, and governing law survive termination.
8. Governing law
This Agreement is governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules.
9. Payment, renewal and cancellation
Paid plans are billed through our payment processor, Stripe. By purchasing, you authorize the charges shown at checkout, including any applicable taxes.
- Subscriptions renew automatically for successive periods at the then-current price until cancelled. You may cancel at any time through the billing portal linked from your account; the cancellation takes effect at the end of the current paid period, and the license remains valid until then.
- Price changes apply to renewals, and we will give notice before a renewal at a new price.
- Refunds. One-time purchases (including Reactor sponsorships) are non-refundable. Subscription payments are non-refundable except where required by law, and cancelling stops future charges rather than refunding the current period. If something has gone wrong, contact us: we would rather fix it than argue about it.
- Invoicing. Organizations that cannot use a checkout page may request invoiced billing by contacting us.
